Terms and Conditions:

Term Definitions:
For the purposes of this agreement the following terms, “company”, “agency”, “travel agent”, “us”, “our”, or “we” refer to 78 Adventures.
The terms “You”, “your”, “passenger”, “traveler”, “customer”, “user”, refer to YOU the customer, who is purchasing travel services from 78 Adventures.
The terms “reservation”, “trip”, “travel”, “adventure”, “excursion”, “departure”, “cruise”, “fare”, “tour”, “event”, “itinerary”, “segment”, or other similar terms refer to the products 78 Adventures sells to you, the customer.
The terms “supplier”, “provider”, “partner”, or “operator” refer to the companies that we buy travel experiences from, for you, such as airlines, cruise lines, tour companies, tour guides, and more.

AGREEMENT

By visiting our website or sharing any information with us and/or using our services, you agree to this entire agreement, irrevocably.

PAYMENTS

A deposit is due to confirm reservation and the amount of this deposit varies by trip or invoice. Fares do not include, additional service charges or insurance payments. Departure Taxes, Visa’s and the like are additional expenses paid by the passenger, and unless otherwise stated are not included. 78 Adventures will advise you in getting a visa if your travel requires it. Full Payment for your trip is due 100 days prior to departure. Payment to 78 Adventures is limited to cash, Credit Card (Visa, MasterCard, Discover, and American Express) and check only. PRE-TOURS, POST TOURS & UPGRADES may be required to be paid in FULL at the time of reservation.

PAYMENT PLANS

If you elect to pay for your trip using one of our Payment Plans, your entire invoice balance will be divided up into 3, 6 or 9 month installments. Payment Plans are not automatic billing. You will be emailed a reminder that your payment is due each month and you will have 7 days to pay the amount due. When choosing a Payment Plan you are OBLIGATED to pay the full amount of your trip, and complete each payment. If you fail to complete your scheduled payment within 7 days of the due date, we reserve the right to cancel your booking without refund of any payments made. You may contact us and cancel your booking at any time to cease billing reminders, however any refund for passenger-canceled bookings are subject to the refund policy below.

Automatic Payments

We do offer automatic payments for some trips. You will be asked to specify if you’d prefer automatic payments during the booking process, if offered. Automatic payments will included a 3% fee per payment, which is non-refundable. Your payments will be processed on the 1st business day of each month following your initial deposit and your final payment will be processed 101 days before your trip departs.

CANCELLATION & REFUND POLICY

If, for whatever reason, your trip is canceled by us, a resort or supplier, or we were unable to book a trip you paid for, you will receive a 100% refund of the entire amount you paid.

It is the responsibility of the customer to purchase trip protection insurance at the time of booking, which offers compensation for trips cancelled due to medical emergency, illness, or other reasons that are out of the customer’s control and not covered by this refund policy.

All advance deposits are non-refundable. When paying immediately in full for any trip, 25% of the payment is considered a non-refundable deposit. When paying by payment plan, deposits are calculated at 10% of the total trip cost and paid as your first payment.

Unless otherwise stated on the trip page under “Terms & Exclusions” you may cancel your trip up to 30 days prior to departure and receive a refund of the remaining balance (less the deposit) as follows:

    • Cancel 120 days or more prior to departure – 90% refund (full refund minus 10% deposit)
    • 119 – 61 days prior – 50% refund of total paid to date;
    • 60 – 31 days prior – 25% refund of total paid to date;
    • 30 days or less – NO REFUNDS.

Discounted tours and Big Deals are non-refundable for any reason. These are general cancellation fees, some of our promotions are non-refundable after booking, in which case please see specific notation on advertising and related paperwork.

Items that are non-refundable for any reason, include but are not limited to: Optional tours, Pre/Post tours or activities, travel insurance, initial booking deposits, airline fees (baggage, upgrades, seating, etc.), reservation change fees, destination hotel or resort taxes and fees, and mandatory advance gratuities, and payment service fees.

PRICING

Of course, prices invoiced after a deposit, will be honored at all times, or the deposit will be refunded at the customer’s request.

All pricing in brochures, the website, advertising and other materials are current at the time of printing and are subject to change without notice. Furthermore, 78 Adventures itineraries, pricing, policies and procedures are constantly evolving. 78 Adventures strives to ensure that all information listed is correct at the time of publication. However, any information contained herein, including but not limited to pricing, is subject to change, and 78 Adventures reserves the right to refuse to honor any prices that were erroneously printed or quoted before booking.

Any changes to a reservation requested by the customer or due to a mistake on the customer’s behalf after the final payment, (for example, change in passenger, change in name.) is subject to a minimum $50 fee per occurrence, plus revision fees from suppliers, if any. Revision Fees (including Premium Air Fees and Choose Your Cabin) are non-refundable and cannot be insured.

FEE SCHEDULE
78 Adventures Travel Co. charges fees for services, often up front, in addition to the cost of your travel. When the travel booked is an organized group package trip developed by us, we do not charge these fees. These fees are only charged if you hire us to design a bespoke vacation package for you. The industry term is “research fee”.

Fees are non-refundable and charged up front.

– Additional travelers in excess of 20 or destinations in excess of 4: $45 each.

DECLINED PAYMENTS

Returned checks are subject to a charge of $59 or 5% of the face value, whichever is greater. In the event that any payment is dishonored or returned for insufficient funds, and such default is not cured after notice pursuant to state law, 78 Adventures shall be entitled to file a civil action against you for three times the amount of the debt, in addition to the payment of the debt, plus court costs, reasonable attorney’s fees and any bank fees incurred by 78 Adventures in taking the action.

LEGAL NAMES & PROOF OF CITIZENSHIP

All passengers’ FULL LEGAL NAME and DATE OF BIRTH as it appears on your PASSPORT  is REQUIRED at the time of deposit or when requested. ANY changes in the spelling of any passenger’s name will required the above mentioned revision fee. PASSPORT, VISA, AND/OR PROOF OF CITIZENSHIP are usually required for this travel. It is YOUR RESPONSIBILITY as the traveler to contact any authorities (U.S. Customs for Americans, or your Foreign Consulate office if you are not a U.S. citizen) to obtain any Passports, Visas, or Proof of Citizenship required. A VALID PASSPORT MUST have six (6) months remaining on the passport after your planned return to the U.S. If it does not, you should renew your passport. 78 Adventures strongly advises that all guests leaving the United States obtain a valid passport for travel. Some countries may deny entry due to current and/or past legal issues. It is your responsibility to check with the local consulate to ensure any legal issues past and/or present do not prevent you from entering any countries you may be visiting on your cruise and/or tour. This is your only notice about providing proof of citizenship, passports, and visa’s. 78 Adventures will not be held responsible for your lack of proper identification or denied entries/denied boarding.

AIRLINE ARRANGEMENTS

Once 78 Adventures purchases any airline or other “common carrier” ticket on your behalf, that ticket will be 100% non-refundable/non-changeable/non-transferable, unless the customer requests a refundable/changeable fare to be booked prior to booking the ticket. If you request 78 Adventures pay ANY airline imposed fees for baggage, seating Assignments, check in fees, etc, as part of your reservation, these fees will be charged to you up front and are non-refundable for any reason. Please contact your specific air carrier directly, or go to their website, for complete information of their additional fees charged. TSA requires that names on Airline tickets MUST MATCH the name as it appears on your passport. Having an incorrectly spelled name could result in additional fees, a new ticket being purchased and/or denied boarding. ANY costs involving a name change to an airline ticket will be the responsibility of the traveler. 78 Adventures is not responsible if an airline cancels or delays a flight for any reason, including weather. 78 Adventures cannot provide any refund for components of trips missed due to canceled or delayed flights, or negligence to meet travel requirements by the customer, but we will do our best to handle any make up arrangements on your behalf. 78 Adventures does not participate in, nor can we assist in providing customer service for any frequent flyer programs. We can, however, enter your membership ID’s when possible, to help you earn your points or miles.

AIRLINE AND TRAVEL SUPPLIER DISCRETION

We will make every effort to accommodate your travel preferences, requests, needs and loyalties as a traveler, however by booking travel through at Travel Advisor, you are entrusting us to make decisions on your behalf. As a Travel Advisor booking your travel, 78 Adventures chooses the best travel options for your trip. Our choices may or may not be based on feedback from you, depending on the travel situation. This means that we may not offer the same or all of the flight itineraries that are available directly to the public, or the same prices. This also applies to all other transportation options like trains, buses, shuttles, ferries, etc. Our goal is to create a stress free, smooth adventure for you and your family. This may mean that we choose a flight itinerary on a particular airline that is not the cheapest or shortest offered by all airlines. We make travel choices on your behalf based on how it fits into your travel schedule (i.e.: Arrival times compared to departure of subsequent travel/experience), quality of the experiences (i.e: a 3 hr flight with no connections vs a 15 hr flight with 2 connections), and our expertise and experience with particular suppliers (i.e.: particular airlines). Overall, this may mean you are booked on a ticket that is not the cheapest option, but is considered the best option for your trip.

HOTEL FEES

Any hotel that requires guests to pay a “Resort Fee”, “Tourist Tax” or a “City Tax” upon arrival at the hotel will be the responsibility of the guest to be paid to the hotel in local currency upon arrival and is not included in the “NO HIDDEN FEES” trip pricing. 78 Adventures is unable to pre-pay these taxes & fees and therefore shall not be held liable to any traveler for reimbursement of these taxes & fees. Whenever possible we will inform the customer of these fees charged by the local vendors as soon as possible.

OPTIONAL PRE/POST TOURS

Optional Pre/Post tours may require a minimum number of passengers in order to operate. Should 78 Adventures cancel an optional Pre/Post Tour, we will refund the entire amount of that portion of your reservation. Cancellations of pre/post tours or activities in no way effects the outlined cancellation or refund policies in place, and any full-trip cancellations by the customer will be governed by the main refund policy outlined above.

OPTIONAL TOURS & EXCURSIONS

Reservations for optional tours and excursions are non-transferable and non-refundable after your final payment is processed. By booking an optional tour, you acknowledge that excursions cannot be canceled by the customer for any reason. Any tour canceled by 78 Adventures for any reason will be refunded. 78 Adventures reserves the right to change any tour, schedule, or to substitute stops and attractions on any tour if needed, and to use substitute equipment or experiences as necessary.

You must contact your Travel Insurance provider to insure your optional tour purchase (or any other additional purchases made to the reservation). Do not assume that tours are insured because you have a policy on your base travel package. 78 Adventures will not be held responsible for tours not insured by your insurance provider.

Optional tours require a minimum number of passengers to operate.  78 Adventures highly recommends that you review optional tours offered by the cruise line/vendor as well as their terms and conditions to ensure you choose the Optional Tours that best fit your travel needs. Additionally, please review your signed passenger information agreement and our general terms and conditions for the trip. That agreement applies to any optional tours you purchase from 78 Adventures.

78 Adventures is acting as intermediary or as an agent for suppliers, airlines, cruise lines, hotels, motor coach, restaurants, sightseeing companies, other travel agencies, etc., in selling services or in accepting reservations or bookings for services which are not directly supplied by this TRAVEL COMPANY. Therefore, this agency shall not be held responsible for any intentional or unintentional or careless actions or omissions on part of such suppliers which will result in any loss, damage, delay, or injury to you or your travel companions or group members.

By participating in our optional tour programs, you agree that you will not, at any time, dispute any charges or process a chargeback with your credit card company. Should a credit card dispute or chargeback occur, you agree to pay 78 Adventures for any costs involved in said dispute or charge back, including but not limited to Bank fees, Legal fees and administrative costs, in placing the debt with a collections service.

INSURANCE

WE HIGHLY RECOMMEND MEDICAL CANCELLATION/INTERRUPTION INSURANCE. PLEASE READ THE CERTIFICATE OF TRAVEL PROTECTION CAREFULLY. IT IS RECOMMENDED YOU COMPARE AND REVIEW OTHER TRAVEL PROTECTION SUPPLIERS BEFORE PURCHASE. BY BOOKING TRAVEL THROUGH 78 ADVENTURES, YOU ARE ACKNOWLEDGING THAT 78 ADVENTURES HAS OFFERED YOU TRAVEL INSURANCE, AND SHOULD YOU CHOOSE TO DECLINE THE OFFER, YOU ARE TAKING RESPONSIBILITY FOR ANY AND ALL CANCELLATIONS. The Travel Protection offered is through a third-party provider. 78 Adventures does not own nor operate any Travel Protection provider, nor has any influence in the outcome of any claim. If we offer a insurance coverage for your trip, it is an optional add-on and non-refundable, and may not cover every portion of your reservation. It is the customer’s responsibility to ensure that the insurance purchased covers the entire trip.

RELEASE OF LIABILITY

By booking services and travel through our services, you accept all liability of injury or damages related to your trip. You agree to hold 78 Adventures Travel Co., 78 Entertainment Group, LLC, and all of their subsidiaries, parents and associates harmless from any damages resulting from injury, physical or financial, while participating in tours, cruises, excursions, activities, flights, transport, or any other segment of your trip. If a court of law awards damages to you, you agree that all damages awarded shall be limited to the entire cost of your travel booked through us, after and minus any funds received from any travel insurance claims. You agree to file a claim and complete it’s processing with your travel insurance policy before seeking monetary compensation from 78 Entertainment Group, LLC or 78 Adventures Travel Co.

DISCOUNTS

We will make every effort to arrange any discount you are eligible for, using our expertise or information you provide. Discounts offered by travel companies (cruise lines, airlines, tour operators, etc.) are not always redeemable through Travel Advisors. Inquire with your travel agent to find out if any discount or coupon you have can be honored.

TRAVEL DOCUMENTS

You will receive your documents approximately 7 days prior to departure via E-Mail or downloadable from our website. Passengers requesting physical documents be mailed to anywhere in the US will be charged a $100 handling fee plus shipping costs.

BAGGAGE ALLOWANCE

Baggage allowances may vary by trip and itinerary, and all information regarding baggage will be included with your booking information.

RESPONSIBILITY

78 Adventures is acting as intermediary or as an agent for suppliers, airlines, cruise lines, hotels, motorcoach, restaurants, sightseeing companies, other travel agencies, etc., in selling services or in accepting reservations or bookings for services which are not directly supplied by this TRAVEL COMPANY (such as air carriage, hotel accommodations, ground transportation, meals, tours, cruises, etc.). Furthermore, 78 Adventures cannot control the circumstances, causes, effects, weather, strikes, bankruptcies, etc., of our suppliers. It is absolutely clear in your acceptance of participation in this trip that 78 Adventures cannot guarantee airlines, flight times, hotels, attractions, shows, restaurants, motorcoach vendors, etc., and any unforeseen changes that might occur in the future. This agency therefore shall not be responsible for any intentional or unintentional or careless actions or omissions on part of such suppliers which will result in any loss, damage, delay, or injury to you or your travel companions or group members.

78 Adventures reserves the right in its sole discretion, and acting as intermediary or as agent for these suppliers, to modify the itinerary, components of the itinerary, or the use of suppliers that is best for the operation of that tour. 78 Adventures is not responsible to any person for expense, loss of time, money, or other circumstances resulting from a change in itinerary or change of tour arrangements. The customer understands that they are purchasing an experience on an itinerary that may change outside of the agency’s control. Should an itinerary or situation change beyond our control, 78 Adventures shall in all situations, strive to provide an acceptable alternative experience at the same or similar value to the original itinerary.   78 Adventures reserves the right to substitute hotels, shows, airlines, restaurants, attractions, etc., of similar quality at any time. If 78 Adventures feel that we are unable to provide a similar experience, generally acceptable to our customers, we shall consider the need for refunds to the customer at that time. Should the customer decide to cancel a reservation, due to changes deemed acceptable to the agency, the standard cancellation and refund policy remains in effect. All rates are subject to Fuel Supplement Charges and Currency Rate fluctuations at any time before or after final payment. Additionally, all requests (such as flight seating, hotel room types, etc.) are requests that cannot be guaranteed and your participation in the cruise or tour in no way assumes that you have been given any guarantees. NO representative of 78 Adventures can make claims of these guarantees to the contrary. 78 Adventures reserves the right to decline to accept or retain any person, as a member of any tour, at any time, and no further obligation will be assumed by 78 Adventures. We also reserve the right to cancel any tour prior to departure, and in such cases all payments will be refunded without further obligation on our part. If a passenger leaves the tour at any time, all return fares and other expenses will be assumed by the passenger. 78 Adventures reserves the right to retain up to its agency revenue in the event of cancellations for any reason. Cruise & Tour passage is subject to the terms and conditions not only in this contract but also those outlined by the vendor.

RESOLUTION OF DISPUTES

If legal action or arbitration is commenced for the breach, interpretation or enforcement of this Agreement, the prevailing party shall be entitled to recover all costs, including attorney’s fees, whether the same be for negotiation, trial or appellate work, incurred by the prevailing party as a result of such breach.

Customer Agrees to indemnify and hold 78 Adventures and its employees harmless from any loss, damage or expense associated with the services provided to Customer by 78 Adventures under the terms of this Agreement. This indemnity and hold harmless shall include, but not limited to, the payment of all Attorney’s fees and costs whether for negotiation, trial, or appellate proceeding, operational costs, staff incurred expenses, and/or any additional costs whether this action is initiated by the client or by 78 Adventures. This indemnity and hold harmless shall survive the termination of this agreement.

This Agreement shall be binding upon the parties hereto and their respective heirs, executors, administrators, personal representatives, successors, and assigns. This agreement shall be construed and enforced in accordance with the laws of the State of California.

SEVERABILITY

Any Provision of this agreement that is determined in any jurisdiction to be unenforceable for any reason shall be deemed severed from this agreement in that jurisdiction only and all remaining provisions shall remain in full force and effect.

AdventureBux™ Referral Program Terms & Conditions

By participating in the referral program, you agree to all of the following conditions:

  • There is a minimum order of $500 ( almost any trip we sell will qualify ) for any discount to be applied – either the referred or the referrer.
  • Discounts do not apply to trip add-ons like travel insurance, service fees, or taxes.
  • AdventureBux™ can only be used on packaged travel through our website ( organized cruises, group trips, etc. ).
  • Your bonus AdventureBux cannot be used with other non-bonus discounts, but AdventureBux codes can be combined up to the value of your remaining balance.
  • AdventureBux cannot be redeemed for cash.
  • You must share the link or code and your friend must use your link or code to receive credit.
  • You may not break the law to share your link or code. Do not send unsolicited email, mobile text messages, telephone calls, or other communications to persons you do not know.
  • You may post the link on the internet, but do not do so in a way which would be considered annoying or spammy.
  • Bookings with a referral discount are not eligible for further discount using AdventureBux.
  • AdventureBux may be used on full payments, deposits or payment plans for eligible bookings. However, if you have already paid for your booking in part or in full, AdventureBux will no longer be able to be redeemed for that trip and cannot apply to amounts already paid, only remaining balances. ( Refer early! )However, all AdventureBux codes are good for 2 years on any future travel booked through our site.
  • Some trips or purchases may be excluded from the program, such as Travel Insurance, Tours, Customized Travel Assistance, etc.
  • You must be 18 or older to participate.
  • We reserve the right to revise or cancel this program at any time.

Privacy Policy

We know that you care how your information is used, and we appreciate your trust that we will use it carefully and sensibly. This notice describes our privacy policy. By visiting our website or sharing any information with us, you are accepting the privacy policy described below.

WHAT PERSONAL INFORMATION DO WE COLLECT?

Information You Provide. We receive and store information you enter. For example, when you search for or buy a product or service, or when you supply information such as your address, phone number or credit card. In addition, you may visit this and other websites anonymously through the use of utilities provided by other private companies.

Other Information: Every computer has an IP (Internet Protocol) address. IP addresses of computers used to visit this site are noted. In addition, we automatically collect other information such as email addresses, browser types, operating systems, and the URL addresses of sites clicked to and from this site. We also use your IP address and registered account information and behavior data to analyze customer behavior and improve customer experience on our website, or provide better customer service.

Information from Other Sources. We might receive information about you from other sources and add it to our account information. This may include updated delivery and address information from our shippers or other sources so that we can correct our records and deliver your next purchase or communication more easily.

This website may include embedded content (e.g. videos, images, articles, chat windows, content feeds etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

HOW DO WE USE YOUR INFORMATION?

To contact you to provide services you request. For example, when you provide your mailing address, email address or phone number, we may contact you using any of these methods to provide the service you’ve requested. By providing this contact information you are explicitly authorizing us to contact you by mail, by email, by voice call or voicemail or by mobile text messaging (“SMS”), to provide services you requested, or for marketing purposes.

Customized Shopping. We use your information to better serve you by providing a customized shopping experience. As noted above, you may “opt-out” of this customization, or even visit and shop anonymously.

Agents. We employ other companies and individuals to perform functions on our behalf. Examples include processing bookings, chat support, customer experience analytics, travel suppliers, delivering packages, sending postal mail and e-mail, and processing credit card payments and more. In most cases, they have access to personal information needed to perform their functions, but may use it for other purposes. For example, cruise lines, air lines, hoteliers and tour operators might use your information to contact you. In these cases, your information is governed by the partner’s own privacy policies, and you have consented to our sharing it with them with the purposes of fulfilling your requests. 

Special Offers. We may send you special offers from time to time, unless you choose to “opt-out” of receiving such offers. In addition, we may also send you special offers from other companies. Again, you may “opt-out”. If we send you offers from other businesses, we do not share your personal information with them. The offers come directly through us. Please see the “opt-in/opt-out” selection at the end of this policy.

Business Transfers. As we continue to develop our business, we might sell or buy stores or assets. In such transactions, customer information generally is one of the transferred business assets. Also, in the unlikely event that we are acquired, customer information will be one of the transferred assets.

Law Enforcement. If we receive a lawful court order to release account or other personal information then we will comply with the law. We will also release information when necessary to protect the life, safety or property of others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

We collect information about visitors who comment on Sites that use our Akismet anti-spam service. The information we collect depends on how the User sets up Akismet for the Site, but typically includes the commenter’s IP address, user agent, referrer, and Site URL (along with other information directly provided by the commenter such as their name, username, email address, and the comment itself).

PUBLIC COMMENTS, PARTICIPATION AND MEDIA

While items like itineraries, billing information and booking information are always kept private, some areas of our website invite you to participation in public internet behavior, such as comments, reviews, forums or other community related participation. This participation can expose your username or email address or other information you post to other users of this website. All of this participation voluntary, and users should be aware and mindful of what they post on our website.

Some areas of our website allow you to share media and images which may be publicly available to other visitors. If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website. We do not monitor this information, and

HOW DO WE PROTECT YOUR INFORMATION?

We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input. We use encryption to protect your information contained in our customer list.

We use a firewall to protect against unlawful intrusion.

We limit access to your information on a “need to know” basis.

We reveal only the last five digits of your credit card numbers when confirming an order. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing using only secure methods.

It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer.
